These Terms of Service ("Terms") govern your use of the Le Visage website and the purchase of products from us. Please read them carefully before placing an order. By accessing our website or purchasing from us, you agree to be bound by these Terms.

SECTION 1 — OVERVIEW AND SCOPE

This website is operated by Parthenon AG, a company incorporated under the laws of Switzerland. Throughout these Terms, the terms "we", "us" and "our" refer to Parthenon AG (trading as Le Visage). Le Visage offers a range of personal care and lifestyle products to consumers (B2C) and to business buyers (B2B).

These Terms apply to all users of the site, including consumers and business buyers. Where these Terms distinguish between consumers and business buyers, the term "consumer" means any natural person who purchases products for purposes that are outside their trade, business, or profession. Business buyers are all other purchasers.

Consumer rights note: Where you are a consumer, mandatory consumer protection laws applicable in your country of domicile apply in addition to these Terms and cannot be excluded by these Terms. Nothing in these Terms limits your statutory rights.

SECTION 2 — ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are of the legal age of majority in your jurisdiction, or that you have obtained parental or guardian consent.

You may not use our products or services for any unlawful or unauthorised purpose, nor may you violate any applicable laws in your jurisdiction, including copyright and intellectual property laws.

SECTION 3 — PRODUCTS AND ACCURACY OF INFORMATION

We make every reasonable effort to ensure that product descriptions, images, and pricing on our website are accurate and up to date. However, we do not warrant that product descriptions or other content is entirely error-free, complete, or current.

Where a product or service offered on our website does not match its description, you may return it in accordance with Section 8 (Warranty and Returns) of these Terms.

We reserve the right to limit the sale of our products or services to any person, geographic region, or jurisdiction, and to limit quantities of any product we offer.

SECTION 4 — PRICING AND PAYMENT

All prices are displayed inclusive of applicable taxes and charges, in Swiss Francs (CHF) for Swiss customers, and in the currency indicated for international orders. Where you are located in an EU country, the price displayed will include VAT at the applicable rate for your country.

We reserve the right to modify prices at any time. Where a price change occurs after you have placed an order but before dispatch, we will notify you and give you the opportunity to confirm or cancel your order.

Payment must be made in full before goods are dispatched. Credit card information is always encrypted during transmission.

SECTION 5 — ORDER PROCESS AND CONTRACT FORMATION

Our website will guide you through the steps required to place an order. You must review and correct any errors before submitting your order. By clicking the "Order with obligation to pay" button, you make a binding offer to purchase the selected products.

A contract between you and Le Visage is formed when we send you an order confirmation by email. We will confirm your order without undue delay. Please retain this confirmation for your records.

We reserve the right to refuse or cancel any order, including in cases of suspected fraud, supply limitations, or pricing errors. If we cancel an order for which payment has already been made, we will issue a full refund promptly.

SECTION 6 — DELIVERY

We will dispatch products within the timeframe stated on our website. Unless otherwise agreed, goods will be delivered within a maximum of 30 days from the date of the order confirmation. If we are unable to meet this deadline, we will notify you and you may cancel the order for a full refund.

Delivery times shown are estimates only and may vary due to carrier delays or customs processing for international orders. Title and risk in the products pass to you upon delivery.

SECTION 7 — RIGHT OF WITHDRAWAL — EU CONSUMERS

This section applies exclusively to consumers domiciled in the European Union. It does not apply to B2B buyers or to consumers domiciled in Switzerland.

If you are a consumer domiciled in the EU, you have the right to withdraw from the contract within 14 calendar days of receiving your goods, without giving any reason. To exercise this right, you must inform us of your decision to withdraw before the 14-day period expires, by contacting us at info@le-visage.ch.

You must return the goods to us within 14 days of notifying us of your withdrawal, in their original condition and packaging where possible. We will reimburse all payments received from you, including the cost of standard delivery (but not any extra costs arising from your choice of a delivery method other than the least expensive standard delivery we offer), without undue delay and no later than 14 days after we receive the returned goods.

The right of withdrawal does not apply to: (a) sealed goods which are not suitable for return due to health protection or hygiene reasons, once unsealed after delivery; (b) goods that have been clearly personalised.

SECTION 8 — WARRANTY AND RETURNS

We take pride in the quality of our products and stand behind every item we sell.

Swiss and International Customers

In accordance with Articles 197 et seq. of the Swiss Code of Obligations, we provide a warranty against defects for a period of two (2) years from the date of delivery. If a product is defective or does not conform to its description, you have the right to:

  • Request repair or replacement of the defective product
  • Claim a price reduction
  • Cancel the contract and receive a full refund, where repair or replacement is not possible or would cause you disproportionate inconvenience

To make a warranty claim, please contact us at info@le-visage.ch within a reasonable time of discovering the defect, describing the issue and providing proof of purchase. We may not be able to accept warranty claims where defects arise from misuse, normal wear and tear, or where defects were known to you at the time of purchase.

Nothing in these Terms excludes or limits our liability for defects that we have fraudulently concealed (Article 199 CO).

EU Consumers — Additional Rights

If you are a consumer domiciled in the EU, the statutory warranty period is a minimum of two (2) years from delivery, during which you may request repair or replacement of a faulty product. If these remedies are not available, you may be entitled to a price reduction or refund. These rights are in addition to any rights you may have under your national consumer protection laws.

SECTION 9 — PRODUCT SAFETY

All products sold through our website are intended to be safe for their intended use when used as directed. We are committed to working with suppliers and partners who meet appropriate quality and safety standards.

Certain products sold through our website carry third-party certifications, which are displayed on the relevant product or information pages. The scope and applicability of any certification is as described on those pages and is subject to change. We do not warrant that all products carry any specific certification unless expressly stated for that product.

SECTION 10 — LIABILITY

Liability We Cannot Exclude

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence or the negligence of our employees or agents
  • Fraud or fraudulent misrepresentation
  • Liability under the Swiss Federal Product Liability Act for defective products that cause personal injury or property damage
  • Any other liability that cannot be excluded under applicable mandatory law

Limitation of Liability

Subject to the above, and to the fullest extent permitted by applicable law:

  • We are not liable for indirect, incidental, or consequential losses, including lost profits or lost data, arising from your use of our website or products, unless such losses result from our wilful misconduct or gross negligence
  • Our total liability to you for any claim arising out of or in connection with your purchase shall not exceed the amount you paid for the product giving rise to the claim

These limitations apply whether the claim arises in contract, tort (including negligence), breach of statutory duty, or otherwise.

SECTION 11 — PERSONAL INFORMATION AND DATA PROTECTION

Your submission of personal information through our website is governed by our Privacy Policy, which is available on our website. Our Privacy Policy sets out how we collect, use, and protect your personal data in accordance with the Swiss Federal Data Protection Act (FDPA) and, where applicable, the EU General Data Protection Regulation (GDPR).

You may place an order on our website without being required to create a permanent account.

SECTION 12 — MODIFICATIONS TO THESE TERMS

We reserve the right to update or modify these Terms at any time. Where changes are material, we will notify existing customers by email at least 14 days before the changes take effect. Continued use of our website or placing of orders after that date constitutes acceptance of the revised Terms.

Any changes to these Terms will not affect orders already confirmed prior to the date of the change.

SECTION 13 — MODIFICATIONS TO PRICES AND SERVICES

Prices for our products are subject to change. Where a price change occurs after you have placed an order but before dispatch, we will notify you promptly. You may cancel your order without charge if you do not agree to the revised price.

We reserve the right to modify or discontinue products or services at any time, with reasonable notice where practicable. We shall not be liable to you for any modification, suspension, or discontinuation of our products or services, except in relation to orders already confirmed.

SECTION 14 — THIRD-PARTY LINKS AND TOOLS

Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of those websites and encourage you to review their terms and policies before engaging with them.

We may provide access to optional third-party tools. These are provided 'as available' and we are not responsible for any issues arising from your use of such tools. Use of third-party tools is at your own risk.

SECTION 15 — USER SUBMISSIONS

If you send us feedback, suggestions, or other submissions, you grant us the right to use and publish such content in any medium, without compensation. You confirm that any submission does not infringe the rights of any third party.

We are not obligated to maintain submissions in confidence, pay compensation for them, or respond to them. We reserve the right to remove any content we determine to be unlawful, offensive, or otherwise objectionable.

SECTION 16 — PROHIBITED USES

You may not use our website or its content for any unlawful purpose or in any way that: infringes intellectual property rights; is defamatory, fraudulent, or harassing; involves the transmission of malicious code or automated scraping; or otherwise violates applicable laws. We reserve the right to terminate access to our website for any violation of these Terms.

SECTION 17 — GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of Switzerland, in particular the Swiss Code of Obligations and the Federal Act on Unfair Competition.

For consumers domiciled in Switzerland, disputes may be brought before the courts of either your place of domicile or the registered place of business of Parthenon AG, at your discretion.

EU consumer rights: If you are a consumer domiciled in an EU member state, you retain the right to bring proceedings before the courts of your country of domicile, or the courts of our registered place of business, at your discretion. This right cannot be excluded by these Terms. EU mandatory consumer protection laws of your country of domicile also apply.

SECTION 18 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall continue in full force and effect.

SECTION 19 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Le Visage regarding your use of our website and the purchase of our products. They supersede all prior agreements, communications, and proposals.
